Welcome to Factarize AI. These Terms of Service ("Terms") govern your access to and use of the Factarize AI platform, services, and website (collectively, the "Service") provided by Factarize Pte Ltd ("Company", "we", "us", or "our").

Factarize AI is an AI-powered content creation platform designed for affiliate marketing in Southeast Asian markets, particularly Indonesia. The Service includes:

• AI persona creation with cultural attributes
• Script generation in Bahasa Indonesia
• AI-powered video generation
• Content scheduling and campaign management
• Analytics and performance tracking
• Product import and management

3. Account Terms

3.1 Account Creation

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Requirements

• You must be at least 18 years old to use the Service
• You must have the legal capacity to enter into these Terms

4. Payment Terms

Video generation costs through third-party providers are your responsibility. You provide your own API keys and are billed directly by these providers.

You agree not to use the Service to:

• Create content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe on intellectual property rights of others
• Create misleading or deceptive content
• Violate any applicable laws or regulations, including advertising and marketing regulations
• Distribute malware or engage in hacking activities
• Impersonate others or misrepresent your affiliation with any entity
• Use the Service for any purpose that is fraudulent or promotes illegal activities
• Attempt to gain unauthorized access to the Service or other users' accounts

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by Factarize Pte Ltd and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

6.2 Your Content

You retain ownership of content you create using the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

6.3 AI-Generated Content

Content generated by our AI tools (scripts, personas, etc.) is provided for your use. You are responsible for reviewing, editing, and approving all AI-generated content before publication.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in accordance with the Singapore Personal Data Protection Act (PDPA).

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• AI-generated content will be accurate, complete, or suitable for your purposes
• The Service will meet your specific requirements
• Results obtained through the Service will be accurate or reliable

YOU USE THE SERVICE AT YOUR OWN RISK. YOU ARE RESPONSIBLE FOR REVIEWING AND VERIFYING ALL CONTENT BEFORE USE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACTARIZE PTE LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Factarize Pte Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Content you create, publish, or distribute using the Service
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

11.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us. Upon termination, you will lose access to the Service.

11.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include breach of these Terms, non-payment, or illegal activity.

11.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and associated data after a 30-day grace period.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Singapore.
